“Through a press conference on Tuesday, 2 June 2010, groups of civil society organizations in Cambodia, including the Cambodian Human Rights Action Committee, the NGO Forum on Cambodia, and the Cambodian Housing Rights Task Force, appealed to the armed forces to protect the interest of citizens, and not that of private companies and traders.

“In the press conference also communities that are affected by land grabbing by companies participated. Also citizens of the Boeng Kak lake community that are facing land grabbing and eviction by the Shukaku company of Senator and Oknha Lao Meng Khin from the ruling party, citizens of the Amleang commune in the Thpong district, Kompong Speu, who are vigorously protesting against land grabbing by the Kompong Speu Sugar and the Phnom Penh Sugar companies of Senator and Oknha Ly Yong Phat from the ruling party, and citizens from Romeas Haek district in Svay Rieng, who suffer from land grabbing by the Peam Cheang Rubber Plantation company, participated.

“A representative of the Boeng Kak lake community in Phnom Penh, Ms. Huot Mony, told the story that has led to violations and intimidations, to grab their land and houses by the Shukaku Inc. company, where many citizens are staff of the Prime Minister’s advisory committees that came to settle there since 1980. In 1993, the number of citizens in the area increased. On 6 April 2006, the Phnom Penh Municipality summoned citizens to meet at the Srah Chok pagoda, informing them that all the citizens in the Boeng Kak lake area would receive land titles – but it then became quiet.

“What makes the Boeng Kak lake residents feel very disappointed and hurt is that the notification of the Phnom Penh Municipality, dated 6 February 2006, said that the Boeng Kak lake area is leased for 99 years for US$79.2 million, with the rate of US$0.60 per square meter, to the Shukaku Inc. company, to develop the area of 133 hectares, where 40 hectares are lake surface.

“Through this agreement, 4,252 families in the Boeng Kak lake area in the Srah Chok commune, Daun Penh district, have been seriously affected by the dredging of sand by the company to fill in the lake. This Boeng Kak lake representative added that the company had laid sand dredging pipes that cause the posts of their houses to become unstable, and they had ordered the authorities to threaten and to prevent citizens from repairing their houses. Some families took out their belongings and the inhabitants moved away, as they were afraid of the danger that their houses might collapse.

“Many problems had happened to the Boeng Kak lake residents – some are concerned that their houses might be burnt down, people might get electric shocks, or their houses might collapse. Sobbing while she was speaking, this representative called on the international community to think about the poor citizens who face evictions, before they decide to grant aid to the Cambodian government.

“Also, a representatives of citizens from the Kompong Speu community in the Amleang commune said that their condition is not much different from what the representative of the Boeng Kak lake area had mentioned.

“This representative said that the Amleang commune residents had worked on their rice fields since before the Khmer Rouge regime, except during the Khmer Rouge regime, and then after 1979, they continued to live on their land, doing farming. Just early this year, Oknha Ly Yong Phat’s company had ordered machinery to clear their farmland and to ban them from farming on their land.

“Facing such a situation leads to serious disappointments, and the activities of the government and of these companies are not a sign of poverty alleviation, but they add a heavier burden on the citizens. In the meantime, it was noticed that when protests against land grabbing took place, private companies often used armed forces to intimidate the victimized citizens. Some cases led to shootings at the citizens, but the perpetrators were not brought to be punished.

“Non-government organizations raised six important demands to the government:

  1. The citizens must be involved in all developments.
  2. There must be proper compensation and agreements when dealing with land disputes.
  3. There must be more effective land dispute mechanisms.
  4. Arrests of citizens over land disputes must be stopped.
  5. The government should be involved in solving land disputes, based on proper procedures.
  6. Armed forces should protect the interests of citizens, and not that of powerful traders.

Officials of the Khmer Rouge Tribunal Travel to New York to Verify Funding – Tuesday, 18.5.2010

“Phnom Penh: A delegation of the Khmer Rouge Tribunal will travel to the headquarters of the United Nations in New York in the United States of America late this week again, to verify the funding for the mixed tribunal – according to officials of the Khmer Rouge Tribunal.

“There was a visit to the UN headquarters after the United Nations and donors agreed in February 2010 to grant US$43 million for the trial of former Khmer Rouge leaders, where US$10.7 million is for the Cambodian side in 2010. But so far, the money has not been transferred into the account of the Cambodian side.

“The head of the Public Affairs Office of the Khmer Rouge Tribunal, Mr. Reach Sambath, said with hope that the delegation of the Khmer Rouge Tribunal, both from the Cambodian and international sides, that will travel to New York late this week, might get positive results relating to the funding for the salaries. The funds for salaries had been promised to be provided to the Khmer Rouge Tribunal, but the money for the Cambodian side has not yet been transferred, while there is no such problem for the international side.

“The Khmer Rouge Tribunal has to spend approximately US$485,000 as salaries for the 294 members of the Cambodian staff. But in April, they received only half of their salaries, as funds for the Cambodian side were not adequate.

“Mr. Reach Sambath added, ‘There are still no salaries for the Cambodian side for May 2010. In April, we could only get half of the normal amounts. There are no salaries for May, but the staff is working as normal, as they had experienced this before.’

“In the meantime, Mr. Reach Sambath added that the judges of the Khmer Rouge Tribunal have not provided the exact date when they will announce the verdict for the Case 001, for the former Tuol Sleng prison chief Kaing Kek Eav, alias Duch.

“Mr. Reach Sambath said, ‘We cannot predict the date when the verdict will be announced for the Case 001, as the judges have not informed us. The date of the announcement of the verdict of the former Tuol Sleng prison chief has been postponed due to problems with the translation of the verdict into three languages (Khmer, English, and French), as this must be written out in detail.

“Anyway, Mr. Reach Sambath said that the verdict will be announced before the co-prosecutors will send Case 002 to the trial chamber, which is planned for September 2010.

“It should be noted that the hearings of Case 01 of the former Tuol Sleng prison chief Kaing Kek Eav, alias Duch, started on 30 March 2009 and finished on 25 November 2009. “In recent months, the import of live pigs from Vietnam into Cambodia on motorbikes – small scale trading, where a motorbike can transport two to four pigs – seems to increase from day to day, while veterinarians do not care to check the pig’s health before they are allowed to be brought in.

“The deputy head of the Cambodian Pig Raiser Association that protects the local pig raisers, Mr. Srun Pov, complained that the collusion to import live pigs from Vietnam to Cambodia through various border crossings, avoiding tax payments and appropriate health checks, is increasing recently.

“Mr. Srun Pov said that obviously, on 10 May 2010, representatives of the association went to check some border crossings in the Ponhea Kraek district, Kompong Cham, and found that hundreds of pigs were imported on that day by traders without proper health checks from expert officials. Just on that morning, the representatives of the associations could see more than 40 motorbikes carrying 3 to 4 pigs each and they gathered those pigs to be delivered into trucks to send them to Phnom Penh.

“He added that to allow the trafficking of live pigs into Cambodia without proper health checks affects the health of citizens who eat pork and harms local pig raisers, as at present, the association is trying to encourage more local citizens to raise pigs.

“On behalf of the Cambodian Pig Raiser Association, Mr. Srun Pov called on the authorities, especially Prime Minister Samdech Dekchor Hun Sen, to take measures to prevent and to eliminate such anarchic import of pigs, because just at the boarder crossings in Kompong Cham, more than 100 pigs were imported each day. What about at other border crossings in Prey Veng, Svay Rieng, Kandal, and Takeo? How many thousands of pigs are being imported illegally?

“Almost unbearable and hotter sunshine is getting public attention; this problem clearly shows that Cambodia is experiencing a change to a hotter climate as part of the global natural phenomena. The typhoon Ketsana indicated that Cambodia starts to face natural disaster, while the temperature is alarmingly getting hotter at present. In rural areas, the heat wave is affecting farmers, making it difficult for them to go out to their rice fields. The wind also brings the heat wave to wherever the people stay, even under the trees they still feel the hot wind.

“According to the weather forecast of 10 May 2010 of the Department of Meteorology, the temperature in low lying areas is 25 to 40 degrees Celsius, at the highlands 26 to 38, at the seashore 22 to 36. Based on the weather forecast of the website http://www.underground.com [not operational at time of editing], the temperature in Phnom Penh is 38 degrees, but the hottest temperature was up to 40 degrees, comparable to Ho Chi Minh City with 36 to 40. Bangkok has a higher temperature than Cambodia with 38 to 41 degrees. Besides, the temperature in Manila/Philippines is 36 to 44 degrees, in Jakarta/Indonesia 35 to 44, in Vientiane/Laos 37 to 43, and in Kuala Lumpur 31 to 42 etc.

“As it is almost the end of the Visakh Lunar Month, the weather should have turned from hot to cooler, but it is seen that in the Kingdom of Cambodia, there is rain in some areas, but in some others there is no rain at all, though the Ministry of Water Resources and Meteorology had forecast that there will be rain everywhere during the rainy season, and there will be no ‘small dry season’ during the rainy season. The hot temperature at present makes it difficult for people to endure it, as they never encountered something like this before.

“An official of the Department of Meteorology said that the temperature is hot because there is no rain. When the rain comes, the temperature will drop. The deputy head of the Department of Meteorology, Mr. Oum Rina, told Koh Santepheap on the phone that in April, in some areas like in Siem Reap and in the northwest, the temperature rose to 41 degrees Celsius. At other areas, the temperature was 38 to 40 degrees, but it declined when the rain came regularly. Mr. Oum Rina added that now, the temperature is still hot. In the northwest, it is 40 degrees and in Phnom Penh, Kandal, Svay Rieng, Kompong Cham, and other provinces and cities, the temperature is only between 37 and 39 degrees.

“He went on to say that the hot temperatures can last until 14 or 15 May 2010, and then they will drop as the rain will start. There will be raining for a few days later in Phnom Penh and in some other areas, and the temperature will go down. “Over a distance of 70 meters dozens of houses fell into the Tonle Sap River on 1 April 2008. Five people were injured and had to be rescued. One child was missing due to the collapse.

“The authorities were evacuating people who reside along the bank of Tonle Sap River in Samaki village opposite of the Psar Touch milk-production factory, in order to avoid any danger of continuous landslides.

“48 houses of 58 families, who live in Group 20, Samaki Village, Russey Keo, Phnom Penh, located along National Road No. 5, opposite the Samaki Market, fell into the Tonle Sap River at 3 p.m.

“The authorities said that 48 houses of 58 families collapsed into the Tonle Sap River, so that five people had to be rescued from the water when their houses collapsed. The rescued people were one child and four old people.

“Kop Sleh, the deputy governor of the above district, said that the collapsed houses were built in a disorderly manner along the river bank.

“He added that the authorities were evacuating the residents along the river bank for fear that the collapse might continue.

“He considered the collapse to be a natural disaster, giving as the reason that now we are in the dry season when the current of the river is weak. A collapse might happen more probably during the rainy season, when the current is much stronger. As for the people who were victimized by the disaster, the authorities are looking for a location for them to live for the time being, in order to wait for permanent solutions later.

“He denied that the collapse was caused by sand dredging operations, even though local people claimed that there were ships dredging sand along the Tonle Sap River at night. According to information from the scene, two children disappeared while their parents were out doing their business.

“This is the second incident after the collapse of the Koh Norea river bank, located in Nirouth, Meanchey, Phnom Penh. That disaster caused the loss of many houses and assets.

“The collapse of the river bank caused citizens’ houses to fall into the river in the afternoon of 1 April 2008 at Samaki village, Russey Keo district. The collapsed land is more than 70 meters long and 30 meters deep. The authorities are seeking for any more missing people.

“Victims said that if the collapse had happened at night, many people would have died, as they return to their houses after their work or business.

“Citizens blamed private companies for causing the collapse of the river bank due to sand dredging operations at night, even though Prime Minister Hun Sen had ordered the relevant ministries to ban private companies from dredging sand in the river.” Chuoy Khmer, Vol.2, #76, 2.4.2008
