Private Mobile Phone Companies Asked Samdech Dekchor to Intervene to Make More Frequencies Available – Friday, 2.7.2010

“Phnom Penh: Private mobile phone companies are encountering a lack of frequencies and cannot provide their services to millions of mobile phone customers well, so they asked the head of the Royal Government of Cambodia to intervene to add more frequencies.
“According to a source familiar with the frequency issue, a licensed private company had asked the Prime Minister of the Kingdom of Cambodia, Samdech Akkak Moha Senapadei Dekchor Hun Sen, to intervene for the company to increase the frequencies available so that the companies can provide better services to their customers.
“The letter of request was also forwarded by Samdech Akkak Moha Senapadei Dekchor Hun Sen to the Minister of Post and Telecommunication, H.E. So Khun. But later, when the company asked to increase the number of frequencies, the Ministry said that there are no frequencies available. Actually, there are unused frequencies, but the Ministry does not make them available.
“Private companies asked the head of the Royal Government of Cambodia, Prime Minister Hun Sen, to intervene supporting their request for the increase of available frequencies for licensed companies, so that they can provide good services to their clients.
“On 27 April 2010, the head of the Royal Government of Cambodia stated during a meeting of the Public-Private Sector Forum that any requests for the increase of the number of frequencies for mobile phone companies, the Ministry has to send them to the Royal Government to decide. But according to a trustworthy source, previously, the Ministry had provided frequencies to some companies without including the head of the Royal Government of Cambodia in the decision. The Ministry did it on its own quietly. Some companies went directly to the Ministry, and the Ministry provided the frequencies to them immediately. However, some licensed companies, that had sent their requests to the head of the Royal Government for the increase of frequencies, had their requests rejected by the Ministry saying that there are no frequencies remaining.
“Some investors of private companies said that mobile phone companies operating at present are seeking ways to serve and to satisfy their clients who use their services, but the challenge is that some licensed companies are not provided with additional frequencies by the Ministry of Post and Telecommunication to provide better services to their clients. Probably, some companies had colluded with the Ministry to receive more frequencies secretly, without involving the whole Royal Government.
“At present, millions of mobile phone clients are annoyed when calling from one phone to another, and some people had requested the companies to expand their service regions to ease communication. But some private companies said that the problem is not their capacity to expand their mobile networks, but the reason is that the Ministry of Post and Telecommunication does not provide them with more frequencies, as requested.

“Immediately after the Cambodian government appointed Mr. Thaksin Shinawatra as Samdech Dekchor Hun Sen’s and the government’s adviser, Bangkok was angry and summoned its ambassador back to Thailand as a so-called diplomatic retaliation. The Thai ambassador left Cambodia in the night of 5 November 2009. In response, the Minister of the Council of Ministers, Deputy Prime Minister Sok An, summoned the Cambodian ambassador to return to Phnom Penh. He considers that this is a normal reciprocity measure between government and government. Regarding this diplomatic dispute, there has not been any new report about border tensions between the two countries.
“Relating to Thailand recalling its ambassador, Mr. Sok An said that this is not the cutting off of diplomatic ties. When Thailand sends its ambassador to Cambodia again, we will send our ambassador to Thailand. He explained that there is no problem in the relations between both countries’ citizens and in commerce.
“He noted that Thailand did so, following a demand from the yellow-shirt group [of government supporters].
“He explained also that it is an internal affairs of Cambodia to nominate Thaksin Shinawatra, and Cambodia had appointed foreigners as advisers before, for example the current president of South Korea. He had also been an adviser of Samdech Dekchor.
“He criticized that Thailand has hurt Cambodia by sending troops to invade the Preah Vihear border areas in Cambodian territory. The second point is that when Cambodia proposed to list the Preah Vihear Temple as a world heritage site, Thailand had sent partisans to disturb it.
“Contrastingly, [Thai] Deputy Prime Minister Sutheb Thaugsuban asked, ‘What would Cambodia think if Thailand nominated [the opposition party president] Mr. Sam Rainsy as adviser?’ Mr. Sok An answered, ‘Cambodia would welcome such a nomination, because Cambodia has a citizen appointed by foreign country. Therefore, Thai people should be happy as one of their citizens is named adviser.’
“The decision of the Bangkok government to summon their diplomatic official like this, pushed the diplomatic ties between both countries to fall to a terrible level, threatening even political, economic, and cultural relation between both countries, as well as the solidarity in ASEAN.
“Prime Minister Abhisit Vijjajiva said that Thailand summoned their ambassador back to Bangkok as a sign of first diplomatic retaliation toward Cambodia for appointing Thaksin Shinawara as adviser, and for rejecting to extradite him. He said that Thailand wants Cambodia to know the dissatisfaction of the Thai people.
“Immigration officials at the Phnom Penh International Airport said that the Thai ambassador boarded the plane at around 9:00 p.m. to travel back to Bangkok.
“Political analysts said that the decision of the Bangkok government will make ASEAN to be viewed as a quite fractioned institution, making the initative to establish the ASEAN community by 2015 to be in hazard, and it is necessary that there is a regional mechanism to restore the situation.
Cambodian Troops Are Prepared to Defend the Country from an Invasion
“At the border, the commander of special Intervention Unit 3, Mr. Srey Dek, said that the Cambodian troops are always on alert. He added, ‘If they dare to enter only half a millimeter, we will attack (open fire) immediately. But he said that so far, there is nothing abnormal.
“The Banteay Meanchey governor, Mr. Ung Oeung, said that the border situation remains normal. But there might be some psychological war coming relating to border closings. But there is nothing visible yet.
Thaksin Is Happy while Abhisit Is Pale
“The Thai former prime minister, Mr. Thaksin Shinawatra, said on Thursday that he accepted the position as economic adviser of the Royal Government of Cambodia, and he expressed appreciation toward Prime Minister Hun Sen for offering this honorable position. He said on his website, ‘I can refresh my brain while I am not yet able to serve the Thai people. I will ask for the permission from Thai people to provide economic advice to the Cambodian government, based on the appointment by King Sihamoni, until I can go back to my country. In fact, I have already become adviser of a government. I accept this position in order to keep my brain to remain fresh, otherwise it would become lame if I don’t keep it up to obtain new ideas and new developments. I want to work with the Thai people, but I cannot. The Thai government does not even allow me to carry a Thai passport.’
“Mr. Thaksin Shinawatra added, ‘Our neighbor is not an enemy. We must be close to each other forever. It is good that we are friends.’
“In the mean time, a legal adviser of Mr. Thaksin, [the former minister of foreign affairs who resigned after the high court found he had violated the Thai constitution] Mr. Noppadon Pattama, spoke to the former prime minister, regarding the issue that Thaksin Shinawatra feels that he has received a great honor, and he will provide advice on how to solve Cambodia’s economic problems and overcome poverty.
“Mr. Noppadon Pattama added that it is not necessary that Mr. Thaksin comes to live in Cambodia, because he can give advice through the telephone or the Internet. He said, ‘Thaksin Shinawatra has no plan to go to Cambodia at this time. Therefore, the government needs not worry or feel afraid, because it is not a political affair or seeking asylum. Mr. Hun Sen decided to appoint Thaksin, because he sees his value and ability.’
“Nevertheless, Thailand does not understand it as Mr. Noppadon does. On 5 November 2009, Thailand summoned their ambassador back to their country immediately as a move of disapproval of Cambodia for offering a position to Thaksin.
“The Thai Prime Minister Abhisit Vijjajiva said to journalist, ‘We have summoned our ambassador as the first diplomatic retaliation toward the Cambodian government so as to let the Thai people’s dissatisfaction known. The announcement of the Cambodian governments disrespects the legal system, and does influence the feeling of the Thai public.
“Abhisit said also that [Thai] aid for Cambodia will be suspended also, but the border between both countries are still open, and the relations between the people will not be affected.” Rasmei Kampuchea, Vol.17, #5040, 6.11.2009

“As Khmer judges of the Khmer Rouge Tribunal threaten, in January 2009, to sue co-defense lawyers of Nuon Chea, the former head of the People’s Assembly of the Democratic Kampuchea regime [the Khmer Rouge], they are destroying justice at the mixed court.
“In a statement released on 9 January 2009, the 15 Khmer judges of the Extraordinary Chambers in the Courts of Cambodia threatened to sue three foreign defense lawyers, defending ‘Brother Number 2,’ Nuon Chea, by taking legal action. Nuon Chea’s defense lawyers lodged a criminal complaint at the Phnom Penh Municipal Court to investigate corruption allegations at this tribunal, which had been reported for a long time. Because the allegations says that Khmer judges and other officials paid kickbacks to high-ranking Khmer officials to get employed at the Khmer Rouge Tribunal, earning thousands of dollars salaries every month.
“The complaint by Nuon Chea’s lawyers was lodged at the Phnom Penh Municipal Court, to investigate Mister Sok An, Deputy Prime Minister and Minister of the Council of Ministers, who is in charge of Khmer Rouge Tribunal affairs, Mister Sean Visoth, the director of the Office of Administration of the Khmer Rouge Tribunal, and Mister Keo Thyvuth, the former chief of the personnel section of the tribunal.
“The defense lawyers of Nuon Chea had not mentioned the names of Khmer judges in their complaint, nor in their statement for the journalists, who had gathered at the Municipal Court last week to report about the process of that complaint. However, the judges of the Khmer Rouge Tribunal seem to know by themselves that Nuon Chea’s defense lawyers’ complaint will really lead the Phnom Penh Municipal Court to investigate them, because Khmer judges may have also agreed to let high-ranking Khmer officials to cut part of their salaries as kickback in exchange for the agreement to let them work as judges in the Khmer Rouge Tribunal.
“The deputy prosecutor of the Phnom Penh Municipal Court started to summon some Khmer officials from the Khmer Rouge Tribunal for questionings about corruption, in order to find evidence and witnesses of corruption related crimes, because the Khmer Rouge Tribunal was created in an attempt to seek justice for around 1.7 million Khmer victims who died during the Black Pajamas regime, lasting 3 years, 8 months, and 20 days. But now, this tribunal committed corruption and is making international groups to loose trust in it.
“Besides the role to seek justice for victims under the Pol Pot brutal genocidal regime, it is hoped that the Khmer Rouge Tribunal will play a model role for the court system in Cambodia to perform just and independent hearings and judgments, and to eliminate corruption and impunity (a state of no punishment for the powerful and the rich who commit different crimes, but who are not brought to be prosecuted). But such hope almost dissolved when allegations about a corruption scandal at the Khmer Rouge Tribunal emerged recently in public.
“The acting director of the lawyers section of the Khmer Rouge Tribunal, Mr. Richard Rogers, said that the reaction by the Khmer judges against the complaint of Nuon Chea’s defense lawyers can be perceived as if this mixed tribunal were reluctant to deal with the allegations of corruption by kickbacks, and this can frighten witnesses of Nuon Chea’s defense lawyers.
“Mr. Richard Rogers added, ‘Now the public sees that the judges of the Extraordinary Chambers in the Courts of Cambodia, that is expected to be a neutral defender of justice, is threatening to take legal action against Nuon Chea’s defense lawyers. The judges should have thought thoroughly before making such a threat, as it seems that they are afraid that Nuon Chea’s defense lawyers’ complaint is also a complaint against themselves.’
“According to a new research by the Human Rights Center at the University of California at Berkeley, Mr. Richard Rogers said that a survey conducted in Cambodia among 1,000 young people shows that 23% of them considered the present Khmer Rouge Tribunal to be corrupt, and one third of them think that the judges of the Khmer Rouge tribunal are not just.

Mr. You Bunleng continued to say that Nuon Chea’s lawyers linked those judges in their statement given to the press. “In a meeting about textile problems among ASEAN member countries, organized in Phnom Penh last week, the Ministry of Commerce of Cambodia encouraged all garment exporting countries in the Southeast Asian region to join to persuade the United States of America to reduce import taxes. This encouragement was made because the garment industries of many exporting countries, including Cambodia, are being affected by the meltdown of the global economy.
“The Minister of Commerce of Cambodia, Mister Cham Prasidh, notorious for corruption, said that persuading the USA is crucial for exporting markets, and it might help to face the economic crisis. Mister Cham Prasidh added, ‘When there is such a global financial crisis, what you see is the decline of demands. How long can our garment sectors stand with this crisis? As we know, we all, more or less, depend on the market of the USA, and this is the reason why we have to continue to try to persuade the USA to be interested to provide us import facilities with reduced taxes or with no tax.’
“Moreover, Cham Prasidh, an in-law of [the Minister of the Council of Ministers] Sok An, went on to say that the garment sector can continue progressing as long as all ASEAN member countries cooperate to expand markets in the region, before receiving better conditions from the USA. Also the deputy director of the Indonesian Textile Association expressed support with what was mentioned above, saying that this was probably a difficult time which needs an immediate solution among ASEAN member countries. Particularly, there must be an encouragement to cooperate in order to compete on the world markets while all countries are facing this financial crisis.
“It should be noted that from 1999 to 2004, the USA provided garment importing quotas to Cambodia without charging import tax. After the Multi-Fibre Arrangement [also known as the international Agreement on Textile and Clothing, 1974 to 2004] system ended, Cambodia has to pay 12.5% tax on average, making prices of garment products from Cambodia becoming more expensive, and it is difficult to compete with products from many other countries in Asia, such as China, Siam [Thailand], Yuon [Vietnam], Indonesia, and Bangladesh; most of these countries also depend on markets in the USA and in Europe.
“However, since many years, the garment sector became the biggest source of income for Cambodia, and it provides employment to more than 350,000 workers in around 400 factories countrywide. Since 2004, garment exports to world markets increased between 20% and 25% every year. Among the income from the export of garment products of US$2.7 billion in total in 2007, the USA absorbed products from Cambodia – especially garments – and the highest level was more than US$1.9 billion, compared to US$600 million for the export to markets in Europe, and US$146 million for the export to Canada.
“Nevertheless, the garment sector in Cambodia is being affected by the decline of garment demand on the US market, after this country, the most powerful country, faced a serious economic meltdown since 2008. The Minister of Commerce of Cambodia said that the garment export from Cambodia to international markets declined by 2% in 2008, so that the government expects that the USA will have policies to promote this sector again. But economists and other experts said that this expectation seems to be baseless.
“The president of a garment factory association in Cambodia recently said that when the economy falls down like this, the USA also needs to help itself. Now, Cambodia is worrying, because so far, around 60 factories have gradually closed and approximately 25,000 workers lost their employment. From April 2009 on, there are little buying orders, and prices have to be lower than before, making many factories to face serious losses.
“Civil society officials observing the garment sector in Cambodia assessed that in mid 2009, 20 more factories will finally close, because they cannot cover losses by bank loans which are also strongly restricted. In the meantime, a foreign economist said that the situation of the Cambodian garment sector might be out of trouble in at most one or two years, when the economy of the USA is expected to grow stronger again. This means that the decline of the garment sector in Cambodia has to wait until the economy of the USA grows strong again, while tens of thousands of Khmer workers of this sector loose their employment and incomes.
“Analysts criticized that corruption in the Ministry of Commerce, managed by Cham Prasidh, and in the Ministry of Labor, administered by Vong Soth, is also a reason making the garment sector in Cambodia face serious decline, because corruption in these two ministries encourages garment factory owners to pay much kickback while their businesses do not earn much profit. Therefore, in order to prevent that the garment sector continues to decline sharply, the Hun Sen government must take action to eliminate corruption urgently, so that factories owners do not decide to close their factories and one after the other leave Cambodia.”Moneaksekar Khmer, Vol.16, #3664, 13.1.2009
