Wednesday, 18.7.2007: Mr. Lim Kean Hor Orders Long Chhin Company to Remove Soil from Kobsrov Lake, and He Takes Action against Those Who Secretly Sell Huge Pieces of Lake Land

“Kandal: Concerning the case that the Long Chhin Company fills soil to grab hundreds of hectares of Boeng Kobsrov Lake land, and the case that a group of officials and dishonest businesspeople prepares documents to take Beong Thom Lake land in Dei Edth Commune, Kien Svay District, Kandal, of more than 100 hectares to sell to businesspeople, now all these dishonest activities and plans are known at the higher levels. The Long Chhin Company, which filled the soil to grab Beong Kobsrov Lake land, is ordered to remove the soil from the lake, and the plan for selling the land of Boeng Thom Lake, which is the water reservoir for the people who do dry season rice farming on thousands of hectares, is definitely ordered to be stopped at the higher levels; if any officials are still stubborn and prepare to sell the lake, they will face being removed or complaints will be filed to the courts, because the water resources law is now in place.

“Mr. Lim Kean Hor, the Minister of Meteorology and Water Resources, told Deum Ampil by phone about the irregularities of filling the lake and the plan for selling the lake land in Kandal, and he affirmed that filling soil to grab Boeng Kobsrov Lake land by the Long Chhin Company is illegal, because this company does not have a license to do such developments on this lake. In the meantime, Mr. Lim Kean Hor said that the Long Chhin Company relies just on a letter signed by Samdech Prime Minister, and they use it to fill soil to grab the lake land. In fact, the letter signed by Samdech Prime Minister tells the Long Chhin Company to contact the Council for the Development of Cambodia to discuss – according to the “one-window procedures” – their development plans, in order to report back and to ask for a decision from Samdech Prime Minister; the letter does not allow the Long Chhin Company to fill soil and to grab Boeng Kobsrov Lake land.

“Regarding this case, Mr. Lim Kean Hor added that now he told also the Kandal authorities to order the Long Chhin Company to remove the soil. If the Long Chhin Company does not comply, the ministry will take legal action, because the water resources management law is in place.

“Separately, concerning the plan of a group of officials and businesspeople in Kien Svay District, Kandal, to take Boeng Thom Lake land in Dei Edth Commune, Kien Svay District, to sell it to businesspeople, he said that he knows everything about this, and he ordered his officials definitely not to sign any documents to sell the lake land; if they dare to sell the lake land, they will face being removed from their positions and face legal action.

“It is affirmed that the Beong Thom Lake is the main water reservoir for the citizens of many communes in Kean Svay District to do dry season rice farming on thousands of hectares, therefore it is not necessary that these citizens have to use water pumps, because the level of the reservoir is higher than the citizens’ dry season rice fields.

“It is also affirmed that on 25 October 2006, a group of businesspeople and officials colluded with each other to make a plan, showing a site of land in Popeal Khae Village, Dei Edth Commune, Kien Svay District, Kandal, and the signature and the seal stamp of Commune Chief Sut To, in order to announce the sale of land of 990 meters by 1,390 meters, equal to 128.7 hectares. In the plan, the site of land, that the commune chief signed and announced to sell, is the lowland of the edge of Beong Thom Lake, which is the water reservoir for the citizens to do the dry season rice farming. Among the land of more than 100 hectares, nearly 100 hectares is lake land and reserved state land, and the other part is lowland at the edge of the lake, occupied by citizens who do farming. In order to sell this land, the businesspeople prepared a plan to construct a road, linked from the Buddhist Center road to the lake land that they prepared to sell. However, this black plot was discovered after the officials and the businesspeople opened the site for construction of a road to the land which meets the land of Oknha Hing Horn, and then they filed complaints against each other to the courts. Not being able to construct the road, those who prepared the plan to grab the lake land for selling, whose names are Ban Prak and Yav Seng Han as the representatives of the citizens, compromised with Oknha You San, that finally Oknha You San decided to allow the construction of a road to the lake land, and the officials of the authorities, with the participation of the land trader Hing Horn, called the citizens together for a ceremony of opening the road construction on 20 June, claiming that this is the development of a road construction for the citizens in that locality.

“A source hinted that after this black issue had been discovered, the officials no longer dare to collude with each other to sell land freely like they did before – they prepared documents to define the lake surface and cut the land, that they had prepared to sell from the map of the lake, so that it became easier to sell the land legally. The plan included a number of high ranking officials and rich businesspeople, pressuring the relevant officials to sign the documents in order to cut the land from the lake, but two relevant offices – i.e. the district office of agriculture, and the office of irrigation – did not agree to sign the documents.

“Finally it was reported that, after newspapers and the Cambodian Television Network had made the plan of preparing the documents to sell Boeng Thom Lake land known, according to some journalists, an urgent meeting on the district level was held in the morning of 17 July at the Kien Svay District Office, and in the evening a meeting on the provincial level, to explain and to solve the above issues.
